1. Introduction

These Terms and Conditions of Use ('Terms') govern the access and use of the cloud-based veterinary clinic management software ('Service') provided by Cerberus Digital ('we', 'our', 'us'). By using our Service, you ('User', 'you') agree to comply with and be bound by these Terms.

2. Acceptable Use of the Service

The User agrees to use the Service responsibly and in compliance with all applicable laws and regulations. It is prohibited to:

• Use the Service for illegal or unauthorized activities.
• Infringe intellectual property rights, including copyrights, patents, trademarks, and trade secrets.
• Interfere or attempt to interfere with the integrity or performance of the Service.
• Access without authorization the company's computer systems or other users' systems.
• Send spam, unsolicited messages, or engage in phishing activities.
• Introduce viruses, trojans, worms, logic bombs, or other malicious or technologically harmful material.

3. Account Registration and Security

To access the Service, the User must register by providing truthful, accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account. You must immediately notify any unauthorized use of your account.

4. Intellectual Property

The Service, its content, features, and functionality are and will remain the exclusive property of Cerberus Digital and its licensors. The User acknowledges and agrees that all content, materials, software, products, services, trademarks, logos, trade names, designs, images, photographs, graphics, illustrations, videos, music, sounds, applications, and other elements available on the Service are the property of Cerberus Digital and are protected by applicable copyright, patent, trademark, and trade secret laws. The User does not acquire any intellectual property rights by using the Service.

5. License of Use

The User acquires a limited, non-transferable, revocable, and non-exclusive license to access and use the Service strictly in accordance with the Terms. The User may not copy, modify, distribute, sell, license, sublicense, assign, or transfer any part of the Service, except in accordance with the Terms. This license is granted solely for your personal or internal commercial use.

6. Fees and Payments

Access to the Service may be subject to the payment of fees. All fees must be paid in accordance with the billing and payment terms specified at the time of purchase. The different plans are available on the Cerberus Digital website. Payments must be made in the agreed currency and on the agreed date. The User may cancel the Service at any time, without the need to provide a reason. To cancel the Service, the User must send a cancellation request through the contact form or the internal support chat. Cerberus Digital reserves the right to modify the fees at any time, committing to notify users at least 30 days in advance.

7. Service Cancellation

Cerberus Digital reserves the right to suspend or terminate your access to the Service at any time, without prior notice, if a violation of these Terms is observed or for any other reason. Similarly, you may also cancel your account at any time. In case of termination, the right to use the Service will immediately cease.

8. Limitation of Liability

The User agrees that Cerberus Digital will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including, but not limited to, damages for loss of data, profits, use, convenience, or marketability, even if advised of the possibility of such damages. The User acknowledges and agrees that the Service is provided 'as is' and 'as available', Cerberus Digital cannot guarantee that the Service will be uninterrupted, error-free, or completely secure.

9. Modifications to the Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new terms on our website and, when appropriate, notifying you by email. Continued use of the Service after the posting of changes constitutes your acceptance of them.
